Right to buy covenant
As permitted by S.157 of the Housing Act 1985, as amended, transfers of properties sold under Right to Buy in this Council’s Areas of Outstanding Natural Beauty restrict sales or lettings to those who fulfil certain criteria. Where one of the following criteria is met, consent to the sale of the property cannot be withheld, and is given by the Head of Asset Management under delegated authority. The criteria are, 1. Having lived or worked in Gloucestershire or an adjoining A.O.N.B. Or National Park for the three years up to the application for consent, or
2. Having previously lived in Gloucestershire for at least three years, or
3. Being a member of the armed forces and having previously lived in Gloucestershire for at least two years.
Under criterion 1 above, if the proposed purchaser has not lived or worked in Gloucestershire for two years up to the application for approval, consent will be automatically denied. Where the applicant has lived or worked in the county for between two and three years, the matter will be considered by the Head of Asset Management.
If there is more than one purchaser, only one of them needs to meet the criteria.
Requests for consent to sales to Registered Social Landlords under the Government’s Mortgage Rescue Scheme are dealt with by the Asset Manager in consultation with the Cabinet Member for Housing.
When the purchasers wish to proceed, their solicitors should send full names together with a note detailing how long and where they have lived or worked in Gloucestershire to me or Mrs Marshfield, so that the request for consent can be answered.
