Planning consent Permission under Class Q(a) & (b) of the Permitted Development Right regulations 2015 was originally granted by South Hams District Council on 26th January 2018 under reference 4051/17/pdm for the conversion of Barn at Merrifield into a residential dwelling. The consent gives Class Q approval for the conversion of Merrifield Barn into a 3-bedroom dwelling together with open plan living which provides a floor area of 96m².

The application was supported by detailed elevation drawings and floor plans together with a structural appraisal prepared by hb Surveying Ltd; however, these plans can be changed and prospective purchasers can submit a revised application to gain approval for the size and type of dwelling that they desire.

A further application3284/20/pdm for prior approval of an agricultural building to a dwelling C3 was required and given by South Hams District Council dated 30th November 2020.

It has also been recognised, in the Appeal decision Mansell v Tonbridge and Malling bc [2017] ewca Civ 1314, that since a Class Q approval has been secured, this is a material planning consideration and can be used as a fall-back position for a future application for a replacement dwelling on the site of [the barn]. This, therefore, means that there is an opportunity for prospective purchasers to submit an application for an architecturally-designed dwelling to replace [the barn] on the site.

conditions The South Hams District Council hereby grant permission to carry out the development described above subject to the following condition(s):

1. The development hereby approved shall in all respects accord strictly with drawing numbers 060917/02 (Proposed Floor Plan & Elevations) received by the Local Planning Authority on 27th November 2017 and SHDC1 & Structural Survey received by the Local Planning Authority on 17th January 2018.

Reason: To ensure that the proposed development is carried out in accordance with the drawings forming part of the application to which this approval relates.

2. If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted, and obtained written approval from the Local Planning Authority for, an investigation and risk assessment and, where necessary, a remediation strategy and verification plan detailing how this unsuspected contamination shall be dealt with.

Following completion of measures identified in the approved remediation strategy and verification plan and prior to occupation of any part of the permitted development, a verification report demonstrating completion of the works set out in the approved remediation strategy and the effectiveness of the remediation shall be submitted to and approved, in writing, by the local planning authority.

Reason: No site investigation can completely characterise a site. This condition is required to ensure that any unexpected contamination that is uncovered during remediation or other site works is dealt with appropriately.

Dartington Dartington is a popular village within walking distance of Totnes along foot and cycle paths. It has a good range of facilities including a fine Victorian parish church, built from materials from a previous church at Dartington Hall, a post office/general stores, primary school, community centre, garage and public house. There is also a playing field, a nature trail along the attractive Bidwell Brook and the popular Cider Press Centre. The village is best known for Dartington Hall, its literature festivals and the many cultural facilities and events that it offers. The A38, within ten minutes' drive, connects to the M5 at Exeter.
