Administrative Area – The Sale Property is within the administrative area of the East Riding of Yorkshire Council, County Hall, Beverley, East Yorkshire, HU17 9BA.

Agricultural holding number - The Sale Property forms part of a larger holding and the agricultural holding number will be retained by the Seller.

Alternative Use – The land is situated close to Newport and may be suitable for renewable energy.

Ancient Monument - The Sale Property or any part thereof is not registered as an ancient monument under the Ancient Monuments and Archaeological Areas Act 1979.

Area of Outstanding Natural Beauty - The Sale Property is not within an area designated as being an Area of Outstanding Natural Beauty.

Area Calculation - The area calculations set out herein are based upon the information provided by the Seller and a Conveyance dated 8 January 1985 made between The Personal Representatives of T G Underwood deceased one part and J H Patchett of the other part.

Basic Payment Scheme - The Seller retains the payment for the current scheme year and the Buyer will comply with the cross compliance requirements from completion to and including 31st December. No Basic Payment Scheme entitlements are included in the sale.

Boundaries – The boundaries marked on the plan "T" have been maintained by the Seller and Seller has cut the field side, and from time to time the top, of the boundaries marked with an end to end double "T".

Coastal Erosion – At present erosion rates the Sale Property is not considered to be at risk from coastal erosion within the next 100 years. 

Completion 11 October 2023. Conservation Area - The Sale Property does not lie in or immediately adjacent to a Conservation Area.

Contaminated Land - The Seller is not aware of any part of the Sale Property having been filled with any contaminating material or matter referred to in the Environmental Protection Act 1990. The Seller does not give any warranty or guarantee in this respect and advises prospective Buyers to make such enquiries and investigations as may be necessary to satisfy the prospective Buyer or Buyers that none of the Sale Property is so filled or contaminated.

Countryside and Rights of Way Act – The land is not subject to any rights of public access.

2019. Winter wheat. Winter wheat. Winter wheat. Description of the Land – The land is within the Newchurch 2 Soil Association the description of which includes that the soil comprises stone less, clayey marine alluvium with a simple soil pattern.

Drainage - The land was drained during the late 1980's, but no drainage plans can now be found. Some outfalls may pass under adjoining land. The land is within the Ouse and Humber Internal Drainage Board Area. The Buyer will have the benefit of any drainage rates paid for the current IDB financial year.

Employment - Transfer of Undertakings (Protection of Employment) Regulations 1981 - The Sale Property is not sold as a going concern and the Seller will indemnify the Buyer against any obligation which is passed to the Buyer under the aforementioned regulations.

Entry (Early) – Following exchange of contracts and before completion and on the payment by the Buyer of a further deposit equal to 10% of the purchase price the Seller will grant to the Buyer a gratuitous licence for the Buyer to enter the purposes of autumn cultivations.

Environment Agency – The Seller is not aware of any reported pollution incidents effecting the Sale Property. The Sale Property shown on the Environment Agency Flood maps as being within Flood Zone 3.

Environmentally Sensitive Area - The Sale Property is not within an Environmentally Sensitive Area.

Environmental schemes – The land is part of a Mid Tier Countryside Stewardship Agreement number 1059656 Agreement End Date 31 December 2025. Hedge options affect the Sale Property i.e. not to cut more than 50% of all hedges in any one calendar year, save for annual cutting in the interests of public safety. The Buyer will covenant with the Seller within 30 days of Completion to obtain, complete and return to Rural Payments Agency a Transfer Request Form in respect of the purchased Lot(s). The intention being to create a separate Countryside Stewardship Mid term agreement in respect of the purchased Lot(s), the term of which will be the same terms as existing agreement. Failure to comply will result in the Seller being obliged to make repayment to the Rural Payments Agency in respect of the entire Countryside Stewardship Mid term agreement ("the Repayment"). The Buyer shall indemnify the Seller in respect of the Repayment and any costs associated therewith due to the failure of the Buyer in complying with this requirement.

Fixtures and Fittings - There are no fixture and fittings included in the sale other than those referred to in the sales particulars.

Forestry – The Sale Property is not subject to any forestry schemes or agreements.

Genetically Modified Organism - The Sale Property has not knowingly been used for the growing of experimental genetically modified organisms or crops.

Health and Safety - When viewing please take such steps as may be reasonably necessary to ensure your safety.

Heritage Coast - The Sale Property is not within the Heritage Coast.

Land Classification - The Sale Property is shown on the Ministry of Agricultural Fisheries & Food Agricultural Land Classification sheet number 98 as being grade 3. 

Land Registry Title YEA62388 Listed Buildings - The Sale Property does not include any listed building nor is it considered by the Seller to be within the setting of a listed building.

Minerals - The Seller's entitlement to minerals is included in the sale in respect of all of Lot 1 and the southern part of Lot 3, but not Lot 2 or the northern part of Lot 3 which the Church Commissioners for England reserve the right of the Lord referred to in the 12th Schedule of the Law of Property Act 1922.

Mode of sale – Tender. The closing date for tenders is 12 noon on Thursday, 21 September 2023. Tenders can be made for each lot, as a whole or any combination of Lots. Customised tender packs will be sent on request.

National Park - The Sale Property is not within or on the edge of a National Park.

Nitrate Vulnerable Zone - The Sale Property is within a Nitrate Vulnerable Zone.

Notices - The Seller is not aware of any notices having been served in connection with the Sale Property within the last four years and if any such notices are served prior to completion then the Seller will undertake to provide copies of such notices to the Buyer.

Outgoings – The Seller is not aware of any outgoings other than drainage rates payable to the Ouse and Humber Internal Drainage Board.

Overage – The Sale Property is not subject to any overage provision.

Ramsar –The Sale Property does not include a Ramsar Site.

Rights of Way – The Seller is not aware of any public rights of way affecting the Sale Property and non-are shown on the online version of the Definitive Map.

Roads – The Sale Property has frontage to a public road.

Sale Property - The Sale Property is all that property within Land Registry title number YEA62388.

Lot 1 18.604 acres (7.53 ha) of prime arable land situated on the west side of Wallingfen Lane, and south of Newfield and opposite Saltmarsh Grange, Newport. The land is bounded to the west by a Green Lane or track marked on the Ordnance Survey plans as "Collinson Lane". The Seller will only consider tenders above £200,000 for Lot 1.

Lot 2. 34.139 acres or thereabouts (13.82 ha) of productive arable land situated on the east side of Wallington Lane opposite Wallington Grange and Elm Tree Farm, Newport and bounded on the south by a Green Lane or track marked on the Ordnance Survey plans as "Lamb Lane". The Seller will only consider tenders above £375,000 for Lot 2.

Lot 3. 22.079 acres or thereabouts (8.94 ha) of heavy yielding arable land situated on the east side of Wallington Lane immediately north of Skelton Grange, Newport. The Seller will only consider tenders above £240,000 for Lot 2.

Seller - The Seller is the person or persons who own or have an interest in the Sale Property and where appropriate the reference includes the outgoing tenant.
