TENANT INFORMATION



 



For properties in Wales, the Renting Homes (Fees etc.) (Wales) Act 2019 means that in addition to rent, lettings agents can only charge tenants the following permitted payments



Holding deposits (a maximum of 1 week's rent).



Security deposits.



Where required, utilities (electricity, gas or other fuel, water, sewerage), communication services "telephone, internet, cable/satellite television), TV licence.



Council tax (payable to the billing authority).



Interest on the late payment of rent (where required under the tenancy agreement).



A breach of a term of the contract (where required under the tenancy agreement).



Any other permitted payments under the Renting Homes (Fees etc.) (Wales) Act and regulations applicable at the relevant time. This could include Payments in Default - examples of types of default payments could be:



Missed Appointments (such as the Agent arranging with a tenant for a contractor to carry out remedial work at the property, and a tenant subsequently refusing entry, or not being home to allow entry, resulting in charges to the landlord, as they appear on the stated invoice.



Avoidable or purposeful damage to property damage to a property caused by neglect or carelessness or wilful behaviour by the tenant. The cost would be based on an invoice for the repairs and would not exceed the stated amount.



Replacement Keys loss of keys by the tenant requiring the landlord or the landlords agent to arrange for the cutting of new keys and delivery of those keys to the tenant. The cost being equivalent to the actual cost of key cutting as stated on the invoice and delivery by first class post.



Emergency/out of hours call-out fees fees incurred as a result of a landlord or landlords agent arranging for someone to attend the tenants property at the request of a tenant, such as a locksmith or an emergency glazier at the early hours of the morning, when the problem has been caused by the tenant in the first place, such as a window broken on purpose or keys locked inside a house. The cost to be determined by either the contractors invoice where an external contractor is used or 50.00 if a member of the landlords agents workforce attend outside normal office hours that is 9am to 5.30pm Monday to Friday.



Tenant protection



In addition to publishing relevant fees, lettings agents are also required to publish details of:



the redress scheme they are a member of; and



the name of the approved or designated Client Money Protection scheme they are a member of (if any).



Please note that lettings agents are required by law to publish on their websites information for potential tenants about relevant fees, redress schemes and client money protection schemes (including the names of those schemes). Relevant fees must also be published on third party websites,

Application Process



To afford a property you will have to proof affordability, this means that you will need an income of 2.5 times the annual rent.



Referencing and Right to Rent Checks - You will be asked to complete an application before referencing can be undertaken, you should also provide an original photographic Identification (e.g., passport, National ID card, VISA, resident permit, driving licence) and Proof of Residence (e.g., original utility bill, council tax bill. You will also be asked for 3 months old bank statements, if you have any queries relating to this, please speak to the branch you are dealing with.



You should be aware that the need for a guarantor may not become apparent until your referencing (including references for any joint tenants) has been completed. Where a guarantor is required, the guarantor must be able to prove affordability (3 times the annual rent), they will need to complete an application form and provide photographic identification and proof of residence.



Referencing will cover a check against the credit file and public records of the individual, an Anti-Money Laundering check, confirmation of employment and salary details, confirmation of previous tenancy details, right to rent checks, reporting the results of all those checks to your prospective landlord to see if your application is acceptable.
